By using The Clinic, you agree to use it lawfully, respect the content and the community, and accept that everything published is educational — not investment advice. You can cancel anytime. Refunds are handled case-by-case within 7 days. Disputes are governed by California law.
1. Acceptance of Terms
These Terms of Service ("Terms") govern your use of The Clinic ("we," "us," "the Site," "the Publisher"), the website at theinvestingclinic.com, all associated newsletters, the community Discord server, and any related services we operate (collectively, the "Service").
By accessing the Site, creating an account, subscribing to any tier, or otherwise using the Service, you confirm that you have read, understood, and agreed to these Terms. If you do not agree, do not use the Service.
2. Eligibility
You must be at least 18 years old to create an account, subscribe, or otherwise use the paid features of the Service. By using the Service, you represent that you are at least 18, have the legal capacity to enter into binding contracts, and are not barred from receiving services under applicable U.S. or international law.
3. Accounts
Some features require you to create an account. When you create one, you agree to:
- Provide accurate, current, and complete information
- Keep your password and access credentials confidential
- Notify us promptly of any unauthorized account access at doc@theinvestingclinic.com
- Take responsibility for all activity that occurs under your account
We reserve the right to suspend or terminate accounts that contain false information, engage in abusive behavior, share access with non-subscribers, or otherwise violate these Terms.
4. Subscriptions and Billing
The Service offers paid membership tiers with monthly and yearly billing options. By subscribing, you agree to the following:
- Recurring billing — your subscription automatically renews at the end of each billing period unless you cancel before that period ends
- Payment processing — payments are processed by Stripe; you authorize us to charge the payment method on file at the start of each billing period
- Pricing changes — we may change subscription prices with at least 30 days' notice; you can cancel before the change takes effect if you don't agree
- Failed payments — if a payment fails, we will retry per Stripe's standard schedule; persistent failure may result in suspension of your access
- Tax — prices are listed exclusive of any applicable sales tax, VAT, or similar taxes that may be added at checkout
5. Cancellation and Refunds
You can cancel your subscription at any time from your member account page. Cancellation takes effect at the end of your current billing period, and you keep access until that period ends.
Refund policy:
We handle refunds on a case-by-case basis within 7 days of the original charge. If you believe you've been charged in error, are dissatisfied with the Service, or have another good-faith reason to request a refund, contact doc@theinvestingclinic.com within 7 days of the charge and explain the situation. We will respond within a reasonable timeframe.
Refund requests outside the 7-day window may still be considered, but are not guaranteed. We do not refund partial billing periods after the 7-day window has passed.
6. Intellectual Property
All content published by the Service — including but not limited to articles, posts, newsletters, research reports, trade ideas, charts, graphics, video content, audio recordings, brand elements, and the design and code of the Site — is owned by the Publisher or licensed to the Publisher and is protected by U.S. and international copyright, trademark, and other intellectual property laws.
What you may do:
- Read and view content for your personal, non-commercial use
- Quote short excerpts (typical "fair use" — generally a paragraph or less) with proper attribution and a link back
- Share a link to a public post on social media or by email
What you may not do:
- Republish, redistribute, or repost full articles or research without written permission
- Share members-only content with non-members in any format (including screenshots, copy/paste, or summaries that reproduce the substantive analysis)
- Use any content to train machine-learning models without written permission
- Remove or alter copyright notices, attributions, or branding
- Use the Publisher's name, branding, or logos in a way that suggests endorsement, affiliation, or partnership without written permission

7. User Conduct and Community Rules
The Service includes community features (Discord server, post comments, member discussions). When using these features, you agree not to:
- Post or share content that is illegal, defamatory, harassing, threatening, hateful, or sexually explicit
- Impersonate another person, the Publisher, or any organization
- Solicit, promote, or advertise outside investments, schemes, products, or services without permission
- Share trade ideas as if they were professional advice or guarantees of return
- Share members-only content with non-members
- Attempt to gain unauthorized access to any part of the Service, its infrastructure, or other users' accounts
- Use bots, scrapers, or automated tools to access content or community features
- Disrupt the community through spam, flooding, off-topic content, or bad-faith argumentation
We reserve the right to remove content, suspend access to community features, or terminate accounts of users who violate these rules. Repeated or serious violations may result in permanent ban without refund.
8. User-Generated Content
You retain ownership of any content you post in community channels (comments, Discord messages, etc.). By posting, however, you grant the Publisher a non-exclusive, worldwide, royalty-free license to display, distribute, and moderate that content within the Service.
You are solely responsible for the content you post. The Publisher is not responsible for the accuracy, legality, or appropriateness of user-generated content, and posting does not constitute endorsement by the Publisher.
9. No Investment Advice
All content published by the Service is for educational and informational purposes only and does not constitute investment advice, financial advice, tax advice, legal advice, or a recommendation to buy, sell, or hold any security or financial instrument. The Publisher is not a registered investment adviser. For full details, please review the Terms, Disclosures, and Risk Statement, which is incorporated into these Terms by reference.
10. Third-Party Services and Links
The Service uses and links to third-party services (Stripe, Discord, Ghost, Mailgun, Cloudflare, and others). The availability and behavior of these services is outside our control. The Publisher is not responsible for the privacy practices, content, or availability of any third-party service. Your use of those services is subject to their own terms and policies.
Posts may contain links to external websites, articles, or sources for context or reference. The Publisher does not endorse and is not responsible for the content of external sites.
11. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. THE PUBLISHER DISCLAIMS ALL WARRANTIES INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.
The Publisher does not warrant that the Service will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Content accuracy, availability, and timeliness are not guaranteed. Past performance of any investment idea, analysis, or strategy discussed is not indicative of future results.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT WILL THE PUBLISHER BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, INVESTMENT LOSSES, LOSS OF DATA, BUSINESS INTERRUPTION, OR GOODWILL, ARISING FROM OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE LEGAL THEORY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND WHETHER OR NOT THE PUBLISHER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
THE PUBLISHER'S TOTAL CUMULATIVE LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID THE PUBLISHER IN THE 12 MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, the limitations above apply to the fullest extent permitted by law.
13. Indemnification
You agree to indemnify, defend, and hold harmless the Publisher and its affiliates, officers, agents, and employees from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising from or relating to: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any rights of a third party, including intellectual property or privacy rights; or (d) any content you post or share through the Service.
14. Termination
You may terminate your account at any time by canceling your subscription and emailing doc@theinvestingclinic.com to request account deletion.
The Publisher may suspend or terminate your access to the Service at any time, with or without notice, if we believe you have violated these Terms, engaged in abusive behavior, threatened the security or integrity of the Service, or for any other reason at our sole discretion. In the event of termination for cause, no refund is owed.
Sections that by their nature should survive termination (including but not limited to Sections 6, 9, 11, 12, 13, 15, and 16) will survive.
15. Governing Law and Jurisdiction
These Terms are governed by and construed in accordance with the laws of the State of California, without regard to conflict-of-laws principles. You agree that any dispute, claim, or proceeding arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Fresno County, California, and you consent to the personal jurisdiction of those courts.
16. Dispute Resolution
Before filing any formal legal claim, you agree to first contact doc@theinvestingclinic.com with a description of the dispute and to attempt in good faith to resolve it informally for at least 30 days.
If the dispute cannot be resolved informally, the parties may pursue available legal remedies in the courts identified in Section 15. Nothing in this section prevents either party from seeking injunctive relief in court for matters involving intellectual property, confidentiality, or unauthorized access to the Service.
17. Changes to These Terms
We may update these Terms from time to time. The "Last updated" date at the top of this page reflects the date of the most recent revision. Material changes will be communicated through a notice on the Site or by email to active subscribers at least 30 days before they take effect.
Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you don't agree, you must cancel your subscription before the changes take effect.
18. Severability and Entire Agreement
If any provision of these Terms is found by a court of competent jurisdiction to be unenforceable, that provision will be enforced to the maximum extent permissible, and the remaining provisions will remain in full force and effect.
These Terms, together with the Privacy Policy and the Terms, Disclosures, and Risk Statement, constitute the entire agreement between you and the Publisher with respect to the Service and supersede any prior agreements or understandings.
